VERBAL APPRAISAL AGREEMENT


AGREEMENT made this day of 2008 between (Owner) located at , (Owner address) and Claudia Miller, The Antiques Appraiser, North Palm Beach , Florida 33403, Tel 561 848 8466.
It is agreed as follows:

1. SERVICES. Appraiser will perform a verbal appraisal of the items located at based upon the terms of this Agreement.

2. PURPOSE. The purpose and function of the appraisal is to establish Value on the subject property for .

3. PRIMARY DUTIES. Appraiser will inspect , research and provide a verbal report of the findings to the Owner.

4. PRIMARY DUTIES. Appraiser will establish the value on items located at the above location. The value of the items will be determined using the following criteria: The current established market value of items; based on the characteristics of value and elements of quality, most active marketplace, and comparable sales; through research and methodology performed by the Appraiser. The appraisal is the educated opinion of the Appraiser and she will not advocate a value higher than that established by using the above method. Appraiser will, however, defend her position in regard to the value of a particular item.

5. RESTRICTIONS. Unless otherwise stated this appraisal will serve only as a means of establishing the value of each particular item and not as a proof of the authenticity of an item and have no limited interest conveyed other than those stated in agreement.

6. DESCRIPTION.

7. MANNER OF PAYMENT. Services rendered at the flat rate _______________________________Dollars per hour with a retainer fee in the amount of ______________________________payable upon signing of the agreement. The balance of fee shall be paid upon receipt of statement notifying final stages of appraisal work. The Appraiser shall then mail the appraisal document to the Owner upon receipt. ________________________________________________________ .


8. PROFESSIONAL RESPONSIBILITY. Nothing in this Agreement
shall be construed to interfere with or otherwise effect the rendering of services by Appraiser in accordance with her independent and professional judgement. Appraiser shall perform her services substantially in accordance with the Principals and the Codes of Ethics of the American Society of Appraisers, Uniform Standards of Professional Appraisal Practice, The Appraisers Association of America.

9. OBLIGATION TO GIVE COMPETENT SERVICE. It is unethical
for an appraiser to claim or imply that she has professional qualifications which she does not possess or to state her qualifications in a form which may be subject to erroneous interpretation. Collaboration between appraisers and special professionals is sometimes necessary to expedite the completion of work or to obtain the benefits of combined judgment or combined data. The principal appraiser builds her final conclusions on these contributions, taking responsibility for the final result but subject to the validity of the underlying or constituent contributions.

10. ENTIRE AGREEMENT. This instrument, the Appraisal Agreement and the attached Certification contain the entire agreement between Owner and Appraiser in regard to this appraisal and any agreement or representation respecting the appraisal or the duties of either the Owner or Appraiser in relation thereto that is not expressly set forth in this Agreement is null and void.

11. PARTICIPATION OF OWNER. The Owner will provide the
following: photographs and all pertinent information on each item.

I certify that, to the best of my knowledge and belief:

The statements of fact contained in this verbal report are true and correct.

The reported opinions of value, are my personal, impartial, and unbiased professional analyses, and conclusions.

I have no present or prospective interest in the property that is the subject of this verbal report and no personal interest with respect to the parties involved.

My compensation for completing this assignment is not contingent upon the development of reporting of a predetermined value or direction in value that favors the cause of the client, the amount of the value opinion, the attainment of a stipulated result, or the occurrence of a subsequent event directly related to the intended use of this appraisal.

My analyses, opinions and conclusions were developed, and this report has been prepared, in conformity with the Uniform Standards of Professional Appraisal Practice.

I have made no personal inspection of the property that is the subject of this report and base my opinion of value on the photographs and information provided by the client.

No one provided significant personal property appraisal assistance to the person signing this certification.
